Is it possible to sue your husband’s mistress?
This is a tough question and is not easily answered. With that being said, I believe the answer would be yes, it is possible to sue one’s husband’s mistress. Depending on the situation, such a lawsuit could be brought for a variety of reasons, including defamation of character, intentional infliction of emotional distress, alienation of affection, or even for breach of contract if there was an agreement between the mistress and the husband.
Defamation of character occurs when one makes false statements about another that cause harm to the other's reputation or standing in the community. In some jurisdictions, this includes statements made by a third party about one's spouse, even if the statements were made to the spouse’s mistress. Intentional infliction of emotional distress occurs when one party engages in extreme and outrageous conduct that causes another party emotional distress. This can include actions by the mistress that are intended to harm the other spouse, such as encouraging the spouse to leave his or her marriage. Alienation of affection occurs when one party interferes with the relationship of another, typically between a married couple. This can include a mistress engaging in conduct intended to break up a marriage.
Finally, if the husband and mistress had a contract between them that the husband failed to fulfill, the mistress could sue for breach of contract. For example, if the husband promised the mistress money or other benefits in exchange for her not revealing the affair, and he failed to fulfill his end of the bargain, she could sue him for breach of contract.
