You have to go to court.

First question for you - do you have a court order in place? If so then you’ll need to show a substantial and a material change in circumstances. Changing legal custody of a child can be a complex process that requires careful consideration and adherence to the relevant laws. It is important to note that decisions related to child custody are made with the child’s best interests in mind, so any changes to legal custody must be in the best interest of the child.

In most cases, a parent will need to file a petition for modification of legal custody with the court in order to change legal custody. This petition should include all of the reasons why the parent believes the change in legal custody is in the best interest of the child. The court will review the petition and make a decision based on the evidence provided.

The court may also require the parents to attend mediation or other alternative dispute resolution methods to work out the details of the legal custody change with the assistance of a mediator or other neutral third-party. This can be beneficial because it allows the parents to work out a solution that is suitable for both parties without the need to go to court.

The court may also require the parents to attend a hearing in order to determine whether the change in legal custody is in the best interest of the child. The court will consider the parents’ wishes, the child’s age, the child’s relationship with both parents, and any other factors that may be relevant to the case.

In some cases, a parent may be able to reach an agreement with the other parent and submit a stipulated agreement to the court for approval. This is often the preferred route as it allows the parents to control the outcome and make sure that both parties’ needs and interests are taken into account.
