You should first know that I’m not a lawyer, but I’ve seen a lot of family law mediations over the years.

Family law mediation is a process where a trained and neutral third party helps two people work out their conflicts without the interference of the court. When people are having problems communicating about an issue, especially if it's a conflict over something like child-rearing or parenting time, family law mediation can help them solve their problems and improve their communications. I can tell you that in Utah, all family law cases are required to go through mediation with a qualified court rostered mediator.

Family law mediation can be a great way to settle disputes between two parties when it comes to divorce, child custody, or other family law issues. If you are going through a divorce a mediation can save you thousands of dollars.

Mediation is very different from litigation. Litigation is the process of resolving disputes in the court system. In litigation, both parties will hire lawyers and take their cases to court. A judge will hear both sides of the story, come to a decision on what they think would be fair, and then issue an order. That decision may be appealed by either party. Going through this process costs money and time. Family law mediation is much less formal. It provides a space for you and your former spouse to come together with the help of an impartial third party in order to resolve any disputes between you without resorting to litigation. The mediator does not make decisions for you—you are able to come up with an agreement on your own terms and make your own decisions about what you want to do moving forward.
