Can creditors still collect on judgments after they are discharged in bankruptcy?

If you file for bankruptcy, the automatic stay that is put in place includes a protection from creditors. This means that they cannot attempt to collect on any judgments they have against you. However, if the judgment was entered before your bankruptcy filing date, it remains valid and this protection does not apply. This means that the creditor can’t come after you for the amount due because the amount due has been discharged - meaning you aren’t legally responsible for paying it; yet, the judgment is valid and would need to be removed from the attachment to your house for example.

Just because a debtor files for Chapter 7 bankruptcy and all (or most) debts included in the petition are discharged (eliminated) after a set period of time—usually around four months to six months. The judgment is still valid and can show up on credit reports and be attached to your real estate (if you have any) - your best next step is to call and speak with a bankruptcy lawyer.
